1. Agreement to Terms

By signing up for or utilizing any services provided by 4khosting.net ("Company", "We", "Us", or "Our"), you are agreeing to be bound by the following terms and conditions ("Terms of Service"). If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services.

2. Acceptable Use Policy (AUP)

All services provided by 4khosting.net may be used for lawful purposes only. Transmission, storage, or presentation of any information, data, or material in violation of any United States Federal, State, or Local law is strictly prohibited.

The following activities are strictly prohibited on our infrastructure:

Hosting of malicious content, malware, phishing sites, or botnet controllers.
Sending unsolicited bulk email (SPAM) or participating in email marketing campaigns that violate CAN-SPAM laws.
Conducting Denial of Service (DoS/DDoS) attacks or network scanning/probing without authorization.
Hosting copyrighted material without permission (subject to DMCA takedown requests).
Resource abuse that negatively impacts other clients on shared or hybrid environments.

3. Payments and Billing

Services are provided on a pre-paid basis. Invoices are generated 7 days prior to the due date. Failure to pay by the due date may result in immediate suspension of services. Services that remain unpaid 3 days after the due date are subject to termination and data wiping without further notice.

All payments made to 4khosting.net are final. Dedicated servers, colocation, and customized infrastructure setups are non-refundable once provisioned.

4. Service Level Agreement (SLA)

4khosting.net guarantees a 99.9% network and power uptime for all enterprise bare metal servers and colocation environments. In the event we fail to meet this guarantee, clients may request a service credit proportional to the downtime experienced. SLA credits are not issued for planned maintenance windows or actions caused by the client (e.g., misconfiguration, software faults, or exceeding bandwidth allocations).

5. Backups and Data Loss

While we ensure high availability and redundancy at the hardware level, the client is ultimately responsible for maintaining their own off-site backups of all server data. 4khosting.net is not liable for any data loss, corruption, or hardware failure that results in lost information.

6. Account Cancellation

Clients may cancel their service at any time through the Client Area portal. Cancellation requests must be submitted at least 48 hours prior to the next billing cycle to prevent automated renewal charges. Terminated accounts cannot have their data recovered.

7. Limitation of Liability

In no event shall 4khosting.net, its directors, employees, or partners, be liable for any direct, indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the service.

8. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
